Online store Terms & Conditions
Terms for the sale of industrial automation products by Zakład Automatyki Przemysłowej Polrad.
Placing an order requires business details, including a Tax ID (NIP). The Store does not sell to consumers. However, where mandatory law grants a natural person conducting business activity special rights because a specific contract is not of a professional nature for that person, these Terms & Conditions do not exclude or restrict those rights.
General provisions
- These Terms & Conditions set out the rules for using the 6es7.pl online store, placing orders, concluding sales contracts and the rules for delivery, payment, complaints and warranty.
- The Seller is Zakład Automatyki Przemysłowej Polrad, Jodłowa 32, 87-123 Brzozówka, Poland, Tax ID (NIP): 8791609290, hereinafter referred to as the “Seller” or “POLRAD”.
- The Seller can be contacted by phone at +48 507 544 233 or by e-mail at kontakt@6es7.pl.
- These Terms & Conditions are made available free of charge in a form that allows them to be read, saved and reproduced.
Customers and B2B model
- The Store is intended exclusively for businesses: sole traders, legal persons and organisational units to which the law grants legal capacity.
- Placing an order requires the provision of true and up-to-date business details required in the order form, in particular the company name and Tax ID (NIP).
- The Store is not intended for contracts concluded by consumers within the meaning of Article 221 of the Polish Civil Code.
- A person placing an order on behalf of a business declares that they are authorised to act on its behalf or hold the appropriate authorisation.
- Nothing in these Terms & Conditions excludes or limits the rights of a natural person conducting business activity where mandatory law grants that person consumer-like protection because a particular contract is not of a professional nature for that person. Such a person is referred to below as an “Entrepreneur with consumer rights”.
- If the professional or non-professional nature of a particular contract for a natural person conducting business activity cannot be determined from the contract itself, it is assessed in accordance with applicable law. The Seller does not make conclusion of the contract conditional on a declaration that the contract is of a professional nature.
Account and technical requirements
- To use the Store you need a device with Internet access, an up-to-date web browser supporting JavaScript and cookies necessary for the Store to operate, and an active e-mail address.
- If the Store allows orders to be placed without registration, creating an Account is voluntary.
- The Customer must provide accurate information in the Account and update it when it changes.
- Account access credentials should be protected against unauthorised access. The Customer is responsible for actions performed using their credentials where those actions result from the Customer’s act or omission.
- The Customer may request deletion of the Account. Deleting the Account does not result in deletion of data that the Seller is required or entitled to retain by law, in particular sales and accounting records.
- It is prohibited to provide unlawful content, attempt to breach the security of the Store or use the Store in a manner that disrupts its operation.
Products, condition and availability
- The Store offers in particular industrial automation components, including PLC controllers, modules, operator panels, frequency inverters and related devices and components.
- Products may be offered as new or used. The condition of a specific product or variant is indicated on its product page or in the order details.
- Product photographs are for information purposes. Used products may show signs of use or storage consistent with the stated condition, provided that these do not affect the properties covered by the contract.
- Availability is shown on the basis of the Store’s inventory data. For product variants, availability relates to the selected variant.
- The designation “Availability on request” is not an assurance that the product can be delivered immediately. In such a case, the terms and lead time require confirmation by the Seller.
- Catalogue numbers, manufacturer designations and technical parameters are used to identify products. Before placing an order, the Customer should verify that the selected model and variant meet the requirements of their installation.
Placing orders and conclusion of contract
- Orders through the Store may be placed 24 hours a day. They are processed on business days.
- To place an order, the Customer selects a product and variant, specifies the quantity, adds the product to the cart, provides the required business and delivery details, selects the delivery and payment method and then confirms the order.
- Before placing the order, the Customer can review and correct the data, order items, delivery costs and selected payment method.
- Product information presented in the Store constitutes an invitation to enter into a contract and not an offer within the meaning of the Polish Civil Code. Placing an order by the Customer constitutes an offer to conclude a sales contract on the terms resulting from the order and these Terms & Conditions.
- An automatic message confirming that an order has been registered does not yet constitute acceptance of the Customer’s offer unless its content clearly states otherwise.
- The sales contract is concluded when the Seller confirms acceptance of the order for fulfilment or when fulfilment begins, whichever occurs first.
- Before the contract is concluded, the Seller may refuse an order in particular if the product is unavailable, there is an obvious pricing or description error, the business details cannot be verified, required payment has not been received or fulfilment is objectively impossible. The Customer will be informed of the refusal and any payment received will be refunded.
- The order details are recorded in the Store system. The Customer receives order information at the e-mail address provided and, if they have an Account, may also have access to it through the Account.
Prices, VAT and payments
- The Store displays product prices in Polish zloty. The net price is the basic commercial price for B2B customers; where indicated, the gross price is also displayed.
- VAT is added to the net price at the rate applicable to the relevant transaction.
- Delivery costs are not included in the product price unless expressly stated otherwise. The exact delivery cost is shown in the cart or order summary before the order is placed.
- A change in product prices after conclusion of the contract does not affect the price of an already concluded contract, except for correction of an obvious error that prevented the price from being correctly determined before conclusion of the contract.
- Available payment methods include bank transfer and online payments processed by Przelewy24. The range of methods available through Przelewy24 depends on the payment operator’s current offering.
- A pro forma invoice is generated and sent only for orders paid by traditional bank transfer. For online payments processed by Przelewy24, no pro forma invoice is sent.
- Fulfilment of an order requiring prepayment begins after payment has been confirmed by the Seller or payment operator, unless the parties agree otherwise.
- A VAT invoice is issued for every order using the details provided by the Customer.
Shipping
- The standard domestic delivery method is InPost courier delivery to the address specified by the Customer.
- Delivery to European Union countries may be arranged individually as to shipping cost, delivery time and shipping method.
- Delivery cost is calculated automatically based on the products and their shipping classes. A light parcel starts at PLN 20 net; medium and heavy devices may require separate parcels and result in higher costs.
- Current information on delivery methods and costs can be found on the Shipping & payment page and in the cart.
- After payment is received, parcels are usually dispatched on the same business day. This information is indicative and does not constitute a guaranteed dispatch time unless the parties expressly agree otherwise.
- Delivery time also depends on the carrier. After dispatch, the Customer may receive a tracking number.
- The Customer should check the condition of the parcel upon receipt. If the packaging is visibly damaged, it is recommended to document the damage and prepare a damage report with the carrier. The absence of such a report does not deprive the Customer of any rights arising from mandatory provisions of law.
Changes and cancellation of orders
- The Customer may contact the Seller to request a change to or cancellation of an order. Whether a change can be made depends on the stage of order fulfilment.
- Until the contract is concluded, the Customer may withdraw their submitted offer if the declaration reaches the Seller before the offer is accepted.
- After the contract has been concluded, amendment or termination requires agreement of the parties unless the law or these Terms & Conditions grant either party another right.
- If, after conclusion of the contract, fulfilment of the order becomes impossible for reasons beyond the Seller’s control, in particular because actual inventory differs from the records, the Seller will contact the Customer without undue delay to agree further steps and, if the contract is terminated, refund the payment received.
Complaints, statutory liability and warranty
- Complaints concerning a product or order fulfilment may be submitted to kontakt@6es7.pl or to the Seller’s postal address. To facilitate handling, it is recommended to provide the order number, catalogue number and product variant, a description of the problem and — where helpful — photographs or other diagnostic materials.
- In relations with a Customer who is not an Entrepreneur with consumer rights, the Seller’s statutory warranty liability for defects is excluded pursuant to Article 558 § 1 of the Polish Civil Code. The exclusion does not apply where it is legally impermissible, in particular in the event of fraudulent concealment of a defect.
- An Entrepreneur with consumer rights is subject to the mandatory provisions applicable to their situation, including provisions of the Polish Consumer Rights Act concerning conformity of goods with the contract where they apply to the specific contract.
- Irrespective of statutory warranty or statutory liability for conformity of goods with the contract, the Seller provides its own warranty: 12 months for new products and 6 months for used products, unless a different period is expressly stated on the product page, in the quotation or in the order confirmation.
- The warranty period runs from the date on which the product is handed over to the Customer.
- The warranty covers defects disclosed during the warranty period that arise from causes inherent in the product and prevent or materially restrict its proper operation in accordance with its intended purpose.
- The warranty does not cover, in particular, damage caused by improper installation, use contrary to technical documentation, incorrect power supply parameters, surges, short circuits, mechanical damage, flooding, environmental conditions outside the device specification, unauthorised repairs or modifications, or normal wear of consumable components — insofar as the relevant circumstance is connected with the defect reported.
- If a warranty claim is accepted, the Seller will, depending on the nature of the defect and product availability, repair or replace the product; if this is impossible or unreasonable, the Seller will agree an appropriate settlement with the Customer, including refund of all or part of the price.
- Before returning a product under complaint, the Customer should contact the Seller to agree how the device is to be delivered and what information is needed to identify the case.
Withdrawal from contract and returns
- A Customer making a purchase of a professional nature in connection with their business activity is not entitled to the statutory 14-day right to withdraw from a distance contract that applies to consumers.
- An Entrepreneur with consumer rights may be entitled to withdraw from a distance contract under the mandatory provisions of the Polish Consumer Rights Act.
- Irrespective of statutory rights, the Seller may, by prior individual agreement, consent to the return of a product by a B2B Customer. Such a return is voluntary and its terms require prior confirmation by the Seller.
- Returning a product without prior agreement does not automatically terminate the contract or create an obligation to refund the price, unless the Customer exercises a statutory right of withdrawal or another right provided by law.
Liability
- The Customer is responsible for selecting the correct product for a specific application unless the Seller has expressly undertaken to make that selection on the basis of complete information supplied by the Customer.
- Information and technical support provided by the Seller do not replace the manufacturer’s documentation, an installation design or an assessment by a person holding the qualifications required for the relevant device or installation.
- In relations with a Customer who is not an Entrepreneur with consumer rights, the Seller’s liability for loss of profits is excluded unless mandatory law provides otherwise.
- The Seller is not liable for failure to perform or improper performance caused by circumstances for which it is not legally responsible, in particular failure of IT or telecommunications infrastructure, actions of public authorities, transport disruptions or another event outside its reasonable control.
- Nothing in these Terms & Conditions excludes liability that cannot lawfully be excluded or limited under mandatory provisions.
Personal data
- The rules for processing personal data and using cookies are described in the documents made available in the Store, in particular in the Privacy Policy.
- Data provided in connection with an order may be processed to the extent necessary to conclude and perform the contract, process payment and delivery, issue accounting documents, handle complaints and comply with the Seller’s legal obligations.
Final provisions
- Contracts concluded through the Store are governed by Polish law, subject to mandatory provisions granting the Customer greater protection.
- Disputes between the Seller and a Customer who is not an Entrepreneur with consumer rights will be resolved by the court having territorial jurisdiction over the Seller’s registered place of business, unless mandatory law provides otherwise.
- For an Entrepreneur with consumer rights, jurisdiction and other procedural rights are determined by provisions that cannot be excluded by contract.
- The Seller may amend these Terms & Conditions for important reasons, in particular changes in law, the operation of the Store, payment or delivery methods, or the scope of services offered. An amendment does not change the terms of contracts concluded before the new version enters into force unless the law provides otherwise or the parties agree to the change.
- If any provision of these Terms & Conditions proves invalid or ineffective, this does not affect the validity of the remaining provisions.
- This version of the Terms & Conditions applies from the date of its publication in the Store.
